TekChat Explicit Consent Statement
This statement exists to obtain your explicit consent to the transfer of your personal data abroad. The document that explains what data is collected and how it is used is a separate one: Privacy Policy. The two are deliberately kept apart — one informs you, this one records your consent.
1. Why is this consent needed?
TekChat relies on Google Firebase for its technical infrastructure. The servers of these services are located outside Türkiye. As a result, when you use the app your personal data is transferred abroad within the meaning of Article 9 of Turkish Law No. 6698 on the Protection of Personal Data.
The law first looks for an adequacy decision issued by the Turkish Personal Data Protection Board for the destination country. To date the Board has not issued such a decision for any country. In that situation the transfer rests on your explicit consent, given after you have been informed of the possible risks.
2. Which data is transferred abroad?
- Account details: your email address, nickname, avatar choice.
- Profile details: your date of birth and gender.
- Chat content: text messages you send in matches and friend chats.
- Usage data: rooms you join, your match history, your online status.
- Purchase data: VIP status, Gold balance, store items. (Your card details never reach us.)
- Notification data: the push token belonging to your device.
- Moderation data: reports and enforcement records.
3. To whom and to which country?
- Google (Firebase): Cloud Firestore, Firebase Authentication, Cloud Functions, Firebase Hosting and Cloud Messaging. Storing, processing and delivering your data happens on this infrastructure.
- Cloudflare: the relay (TURN) servers used when a direct voice connection cannot be established. These servers do not record audio; they only pass it through in real time.
The servers of these providers are located in various countries outside Türkiye, primarily the United States, and a provider may change the region where data resides in order to keep the service running.
4. Possible risks
For your consent to be valid, the risks must be explained to you clearly. What you should know:
- There is no adequacy decision from the Board for the countries your data is transferred to. In other words, it has not been officially established that the level of protection there is equivalent to the one in Türkiye.
- Your data becomes subject to the law of the country where it is held. Authorities in that country may request access to it under their own legislation.
- Exercising your rights or pursuing legal remedies after a breach may be harder and slower than it would be for a domestic transfer.
- The providers named here are subject to their own privacy policies: Google Privacy Policy, Cloudflare Privacy Policy.
5. You can withdraw your consent
Explicit consent can be withdrawn at any time. To do so, write to tekchatapp@gmail.com or delete your account from within the app.
We need to state this plainly: all of TekChat runs on the infrastructure described above. Once you withdraw your consent it is therefore technically impossible to keep using the app, and your account will be closed. Withdrawal is not retroactive: transfers made up to the date of withdrawal remain lawful.
6. What this consent does not cover
This statement governs only the transfer abroad. The purposes for which your data is processed, how long it is kept and what your rights are is set out in the Privacy Policy; the rules for using the app are set out in the Terms of Service.
Your data is never sold or transferred to third parties for advertising or marketing purposes.
7. Record of your consent
When you accept this statement, the date of your consent and the version of the text you accepted are stored on your account, so that it can later be established which text you agreed to and when.
